1. Welcome to Chooseaticket.com. The following are the rules or “Terms” that govern use of the Chooseaticket.com web site (“Site”) and the use of the services offered in this Site (“Services”).
   
   
2. Chooseaticket.com is a business (“Choose A Ticket”, “Us”, “We”) which is owned and administered by Mr. Andrew Cassar who can be contacted at info@chooseaticket.com.


3. Please check this page of the Site periodically for any updates to these Terms. If You violate these Terms, Choose A Ticket may terminate Your use of the Site, bar You from future use of the Site, cancel Your ticket order, and/or take appropriate legal action against You.
   
   
4. By requesting any Services including but not limited to purchasing, booking and/or ordering any tickets from the Site, You expressly agree to be bound by these Terms and to follow these Terms and all applicable laws, regulations and policies governing the Site and the Service.

1. For the purpose of these Terms and without prejudice to specific definitions throughout these Terms;
   
   
   1. ”Event” shall mean a happening/occurrence/occasion taking place at an established Venue and for which a ticket is required for entrance.
      
      
   2. “Ticket” shall include but not be limited to electronic tickets, electronic vouchers and any other tool valid for the entrance into the Venue where an event is held or is to be held.
      
      
   3. “Use” shall include but not be limited to visiting and/or viewing the Site, as well as making use of any Services from this Site.
      
      
   4. “Venue” shall mean the place where an Event for which electronic tickets and/or vouchers are purchased or ordered from this Site.
      
      
   5. “You”, “User” shall mean, whoever visits the Site and/or requests Services offered on this Site.
      
2. Choose A Ticket shall have the right to change, amend, substitute, suspend or in any way alter these Terms at any time without any prior notice whatsoever, and such alterations shall be effective immediately upon posting on the Site.

Permitted Use

1. This Site shall only be used for what it is intended and any illegal and/or unauthorised Use of the Site shall lead to the legal proceedings being taken by Choose A Ticket against the unlawful user. Furthermore, Choose A Ticket reserves the right to restrain such unlawful user from visiting and/or making Use of the Site.

Disclaimers

1. Choose A Ticket does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from Use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. Choose A Ticket cannot ensure that files You download from the Site will be free of viruses or contamination or destructive features. Choose A Ticket disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose.
   
   
1. Choose A Ticket makes no guarantee of any specific result from Use of this Site or its Services.

Choose A Ticket disclaims any and all liability for the acts, omissions and conduct of any third party users, Choose A Ticket users, advertisers, promotes and/or sponsors on the Site, in connection with the Choose A Ticket service or otherwise related to Your Use of the Site and/or the Choose A Ticket service. Choose A Ticket is not responsible for the products, services, actions or failure to act of any Venue, performer, promoter or other third party in connection with or referenced on the Site.

Intellectual Property

1. Any intellectual property on the Site shall remain the property of its owner and/or creator as the case may be. You shall not copy and/or Use such property unless specifically authorised by the owner and/or creator of such property.

1. Copyright Policy

1. You are only authorised to visit, view and to retain a copy of pages of this Site for Your own personal use, and that You shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review an Event and promotional information, for personal use, or to purchase tickets or merchandise for Your personal use, unless otherwise specifically authorised by Choose A Ticket to do so. You also agree not to deep-link to the Site for any purpose, unless specifically authorised by Choose A Ticket to do so. The content and software on this Site is the property of Choose A Ticket and/or its suppliers and is protected by Maltese and international copyright laws.

1. If You would like to make Use of any part of this Site, You must contact the administrator of the Site and request specific clearance as well as pay the applicable copyright fees that may be due.

1. The Printing and/or saving on Your computer/workstation of the electronic ticket which You bought, is partially exempt from Copyright Policy in that it can be printed and/or saved for the purpose for which it is intended.

1. No Association and Non-Affiliation

1. Choose A Ticket should not be associated to and/or affiliated to any other entity and/or person unless such a relationship in fact exists and is governed by an appropriate agreement.

1. Unauthorised Use of the Site

1. Illegal and/or unauthorized Use of the Site, including, but not limited to, unauthorised ticket sales, unauthorised framing of or linking to the Site, or unauthorised use of any software on the site, will be investigated and appropriate legal action will be taken.

1. Violation of the Terms

1. You understand and agree that in Choose A Ticket's sole discretion, and without prior notice, Choose A Ticket may terminate Your access to the Site, cancel Your ticket order or exercise any other remedy available and remove any unauthorised content, if Choose A Ticket believes that the content has violated or is inconsistent with these Terms of Use violated the rights of Choose A Ticket, the User or the law. You agree that monetary damages may not provide a sufficient remedy to Choose A Ticket for violations of these Terms and You consent to injunctive or other equitable relief for such violations. Choose A Ticket is not required to provide any refund to You if You are terminated as a User because You have violated these Terms of Use.

1. Purchase Policy

1. All sales are FINAL, no refunds, cancellations, or exchanges are issued after You have purchased your tickets.


2. You are strongly advised to read and follow any instructions printed on the Ticket.
   
   
3. Choose A Ticket is not responsible for lost, stolen, damaged or destroyed tickets once tickets are in your physical possession.
   
   
4. The User can buy up to four (4) tickets for each Event with the same credit/debit card and up to eight (8) with the same credit/debit card in total in two weeks.
   
   
5. If your first choice of ticket is not available We reserve the right to upgrade or downgrade (partial refund) the order to the next available category or to cancel the order with a full refund.
   
   
6. There may be a slight difference between the advertised price and the actual amount charged due to fluctuating exchange rates.


7. Prices are subject to change inter alia due to increases to taxes and/or change in price by the organiser/promoter of the Event.
   
   
8. All advertised tickets are subject to availability.


9. All ticket orders are binding for You and cannot be cancelled without written acceptance of cancellation by Choose A Ticket. All deposits are non-refundable. If You want to cancel an order, Choose A Ticket might accept this with a 50% cancellation fee. However this must be agreed in advance and in writing by Choose A Ticket.


10. Each User/Customer/Credit Card holder may only be allowed to purchase four (4) tickets for a specific event. Further restrictions may apply.


11. Choose A Ticket shall not be responsible if Ticket is not printed and/or saved in an appropriate format by You, even if this is attributable to limitations of the workstation/computer on which You are viewing/printing/saving the Ticket. It is the User’s responsibility to print the tickets. Once ticket is printed, ticket is considered delivered to the User.


12. At the Event, User must present ID Card and printed ticket.
    
    Any complaints or claim of refund regarding a ticket purchase must be made in writing and received by Choose A Ticket within twenty four (24) hours after the relevant event date. Complaints must be sent to: info@chooseaticket.com. Complaints after this date will not be reviewed. Choose A Ticket will normally review a complaint or claim of refund within four (4) weeks after it has been received by Choose A Ticket.

10. Event Specific Terms and Conditions 

1. Choose A Ticket may issue Event specific terms and conditions which shall be complimentary to these Terms. Nevertheless, unless specifically stated, in case of conflict between the Event specific terms and conditions and these Terms, the Event specific terms and conditions shall prevail for the Use of the Site in relation to and/or the purchase of tickets valid for the specific Event.


2. The organiser/s and/or promoters of a particular Event may also impose on You other terms and conditions which shall also apply. It shall be your responsibility to read such terms and conditions before using this Site and/or purchasing any tickets from this Site.

1. Cancellation and/or Variation of Event 

1. Events may be cancelled, postponed, altered and/or varied by the organiser/promoter of the specific Event. The User/Customer is strongly advised to follow any instructions published and/or in any other manner released by the organiser/promoter of the specific Event.

1. Limitation of Liability

1. In no event will Choose A Ticket be liable to You for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if Choose A Ticket has been advised of the possibility of such damages.


2. In no event will Choose A Ticket be held liable for inter alia the cancellation, postponement, alteration and/or the variation of the Event.


3. We are not responsible for such changes as Event date, Event time, Venue change or weather conditions. Choose A Ticket is not responsible for any tickets which are lost or stolen. No Duplicates can be issued under any circumstances.


4. The maximum liability of Choose A Ticket shall be capped at the total amount paid by the User/Customer for the tickets bought from Choose A Ticket for each specific Event.

1. Indemnity

1. You agree to indemnify and hold Choose A Ticket, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Your Use of the Site, including also Your Use of the Site to provide a link to another site or to upload content or other information to the Site.

1. Governing Law and Jurisdiction

1. These Terms and other policies on this Site shall be construed and interpreted, and the relationship between the User/Customer and Choose A Ticket (collectively referred to as the ‘Parties’) shall be governed in accordance with the Laws of Malta.


2. Any dispute, controversy or claim arising out of or relating to these Terms, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the rules of the Malta Arbitration Centre as in force on the date on which such dispute, controversy or claim arises.


3. The number of arbitrators shall be one (1) and shall be appointed by agreement between the Parties.  Should the Parties not agree on the person who shall be appointed as arbitrator within fifteen (15) days from the date on which either of the Parties may refer the dispute, controversy or claim to arbitration, the arbitrator shall be appointed by the Malta Arbitration Centre.


4. The language to be used in the arbitral proceedings shall be English.
